A. We at DoggyDoo LLP are deeply concerned about your privacy and we take this concern very seriously. This Privacy Policy ("Privacy Policy") sets out how we collect, process, use and may disclose your data when you use our Application called ‘DoggyDoo’ which is referred hereinunder as the ‘Application’. References to "we", "our" or "us" or the "Company" shall mean the DoggyDoo LLP. Any references to "you", "your", "User" and “End-User” shall mean any person or entity using DoggyDoo. We will not use or share your information with anyone except as described hereinunder in this Privacy Policy.
B. This Privacy Policy is a part of and is to be read with the DoggyDoo LLP Terms of Use ("Terms"). By using DoggyDoo, you agree to the terms and conditions of this Privacy Policy. You also consent to our use and disclosure of your Personal Information (as defined below) in the manner described in this Privacy Policy.
C. We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use.
D. By using the services or by otherwise giving us your information, you will be deemed to have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the same. You hereby consent to our collection, use and sharing, disclosure of your information as described in this Privacy Policy. DoggyDoo reserves the right to change, modify, add or delete portions of the terms of this Privacy Policy, at its sole discretion, at any time. If you do not agree with this Privacy Policy at any time, do not use any of the services or give us any of your information. If you use the services on behalf of someone else (such as your child) or an entity (such as your employer), you represent that you are authorised by such individual or entity to (i) accept this Privacy Policy on such individual’s or entity’s behalf, and (ii) consent on behalf of such individual or entity to our collection, use and disclosure of such individual’s or entity’s information as described in this Privacy Policy.
E. This Privacy Policy is published in compliance with, inter alia: (i) Section 43A of the Information Technology Act, 2000; (ii) Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”); (iii) Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
F. This Privacy Policy states the following: (i) The type of information collected from the Users, including Personal Information and Sensitive Personal Data or Information relating to an individual; (ii) The purpose, means and modes of collection, usage, processing, retention and destruction of such information; and (iii) How and to whom DoggyDoo will disclose such information.
1. COLLECTION OF PERSONAL INFORMATION Generally some of the Services require us to know who you are so that we can best meet your needs. When you access the Services, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. You hereby consent to the collection of such information by DoggyDoo. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following: (i) contact data (such as your email address and phone number); (ii) demographic data (such as your gender, your date of birth and your pin code); (iii) data regarding your usage of the services and history of the appointments made by or with you through the use of Services; (iv) other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters. The information collected from you by DoggyDoo may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.
“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to: (i) passwords; (ii) financial information such as bank accounts, credit and debit card details or other payment instrument details; (iii) physical, physiological and mental health condition; (iv) sexual orientation; (v) medical records and history; (vi) biometric information; (vii) information received by body corporate under lawful contract or otherwise; (viii) any detail relating to the above clauses as provided to body corporate for providing service; and (ix) visitor details as provided at the time of registration or thereafter;
DoggyDoo will be free to use, collect and disclose information that is freely available in the public domain without your consent. 1.1. The Information DoggyDoo may collect Contact information We might collect your name, email, mobile number, phone number, street, city, state, pin code, country and IP address. In addition, DoggyDoo will collect demographic data such as your gender, date of birth. DoggyDoo will also seek details of your pet dog like name, age and breed, vaccination details and whether neutered/spayed or not.
Payment and billing information DoggyDoo would never collect your bank details and credit/debit card numbers or credit/debit card expiry dates or other details pertaining to your credit/debit card and/or bank account on our application. This information will be obtained and processed by our online payment partner viz., ‘Razorpay Software Private Limited’ having its registered office at 1st Floor, SJR Cyber, 22 Laskar Hosur Road, Adugodi, Bengaluru, 560030, Karnataka.
Other information If you use our application, we may collect information about your IP address and you are using. We might look at what website you came from, duration of time spent on our application, pages accessed or what site you visit when you leave us. We might also collect the type of mobile device you are using, or the version of the operating system your computer or device is running. 1.2. Manner of collection of Information We collect information directly from you. We collect information directly from you when you register at DoggyDoo. We also collect information if you ask us a question through phone or email or access and use any of the services provided in the Application. We collect information from you passively We use tracking tools like Google Analytics, Google Webmaster, browser cookies and for collecting information about your usage of our Application. We get information about you from third parties For example, if you use an integrated social media feature on our Application. The third-party social media site will give us certain information about you. 1.3. User-provided Information When you register for and use DoggyDoo, you shall provide to DoggyDoo "identity information" (such as your name, email address, address, home or mobile telephone number etc.) along with a photograph of your pet dog. If you decide to register through or otherwise grant access to a third party, social networking or authentication service that we may make available ("Authentication Service"), such as Facebook or Google, DoggyDoo may also collect any such "identity information" that you have provided to the Authentication Service from the account you have with the Authentication Service. If you choose to provide such information, during registration or otherwise, you are giving DoggyDoo the permission to use and store it consistent with this policy. Therefore, please understand that when you sign in with DoggyDoo, you and your pet are no more anonymous to us. 1.4. Accuracy of Information Please make sure that any Personal Information you share with us is accurate and up to date information, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our Application. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or DoggyDoo has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, DoggyDoo may, at its sole discretion, discontinue the provision of the Services to you.
2. USE OF YOUR DATA BY DOGGYDOO DoggyDoo uses the information that you provide or that we collect in order to establish and enhance our relationship with you. DoggyDoo generally uses the information you provide or that we collect to operate, maintain, enhance, and provide all of the features and services found on the Application. If you have given DoggyDoo consent, we may use your personally identifiable information to provide you with information about DoggyDoo's features, services and other offerings that may be of interest to you. We may also send information or offers to groups of users on behalf of other businesses. We use the Personal Information for the following purposes: (i) To inform you about our offers and to respond to your requests; (ii) For creation or development of business intelligence or data analytics in relation to the Offerings provided by us; (iii) To create a user account; (iv) To manage our relationship with you; (v) For internal record keeping; and (vi) To comply with our legal or statutory obligations. All the information provided to DoggyDoo by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that DoggyDoo may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates (d) for communication purpose so as to provide you a better way of obtaining services from DoggyDoo and for obtaining feedback in relation to the Service providers, (e) debugging customer support related issues. (f) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction. DoggyDoo also reserves the right to use information provided by or about the End-User for the following purposes: (i) Publishing such information on the Application. (ii) Contacting End-Users for offering new products or services. (iii) Contacting End-Users for taking product and Service feedback. (iv) Analyzing software usage patterns for improving product design and utility. (v) Analyzing anonymized practice information for commercial use. (vi) Processing payment instructions including those through independent third party service (vii) providers such as payment gateways, banking and financial institutions, pre-paid instrument and wallet providers for processing of payment transaction or deferral of payment facilities. If you have voluntarily provided your Personal Information to DoggyDoo for any of the purposes stated above, you hereby consent to such collection and use of such information by DoggyDoo.
3. DISCLOSURE OF DATA BY DOGGYDOO We do not sell, rent, share, distribute, lease or otherwise provide your Personal Information to third parties, without your prior consent. Keeping this in mind, we may disclose your Personal Information in the following cases: Affiliates We may provide your Personal Information to our affiliates and all business entities to enable them to improve the offers and provide services related to the same. Service Providers We may share your Personal Information with the service providers who work with us providing services on DoggyDoo. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Policy. Merger or Acquisition We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Application, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you. Legal and Regulatory Authorities We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Govt. authorities.
4. RETENTION OF DATA We will retain your Personal Information as long as it is required to be retained for the purpose of provision of the services and to comply with our legal obligations. Subject to this section, we will delete your Personal Information upon reasonable written request for the same. Please note, however, that there might be latency in deleting Personal Information from our servers. DoggyDoo will not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in DoggyDoo being unable to provide you with its Services.
5. OUR SECURITY MEASURES Your Personal Information is stored on third-party cloud servers. We provide appropriate firewalls and protections for the security of Personal Information, however, Personal Data transmitted from these systems are not hack-proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take necessary measures to mitigate such events DoggyDoo maintains a strict "No-Spam" policy, which means it does not intend to sell, rent or otherwise give your e-mail address to a third party without your consent. DoggyDoo has implemented best international market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, DoggyDoo shall not be held liable for any loss whatsoever incurred by the User. DoggyDoo implements reasonable security practices and procedures and has a comprehensive documented information security programme and information security policies that contain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected. DoggyDoo takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy, will only disclose your Personal Information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when DoggyDoo, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.
6. YOUR RIGHTS You have the right to access your Personal Information in our possession, right to have us rectify or modify any such Personal Information, right to have us erase/delete your Personal Information, and right to object to our use of your Personal Information.
7. CHILDREN’S PRIVACY If you are a child under the age of 18 years, please do not provide any Personal Information. If the legal representative of the child discovers that the child has provided us with Personal Information, we request the legal representative of the child to contact us at support@doggydoo.io in to have the Personal Information deleted.
8. CHOICE AND OPT-OUT We may send you communications including but not limited to (a) notices about your use of our Application and Services, including those concerning violations of use, (b) updates, (c) promotional information regarding our Services. You may opt out of receiving promotional emails from us by following the unsubscribe instructions provided in those emails.
9. LINKS TO OTHER WEBSITES Our Application may contain links to other websites/applications of your interest. Please note that we do not have any control over such other websites/applications, and you will be accessing these websites/applications at your own risk. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites/applications and those are not governed by this Privacy Policy. You should exercise caution and look at the privacy policy applicable to such websites/applications.
10. LIMITATION OF LIABILITY To the extent permissible under the law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, information, or other intangible losses (even if we have been advised of the possibility of such damages), arising out of this Privacy Policy.
11. APPLICABLE LAW AND DISPUTE RESOLUTION 11.1. You agree that this Agreement and any contractual obligation between DoggyDoo and User will be governed by the laws of India. 11.2. Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Application or the Services or information to which it gives access, shall be determined by Arbitration in India, before a sole arbitrator appointed by DoggyDoo. 11.3. The Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of such arbitration shall be New Delhi. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute. 11.4. Subject to the above Clause 11.3, the courts at New Delhi shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Application or the Services or the information to which it gives access.
12. AGE LIMIT The User of DoggyDoo must be 18 years of age or older to register, use the Services, or visit and use the mobile Application. By registering, visiting and using the DoggyDoo Application or accepting this Agreement, you represent and warrant to DoggyDoo that you are 18 years of age or older, and that you have the right, authority and capacity to use the Application and the Services available through the it, and agree to and abide by this Agreement.

If we modify this Privacy Policy, we will make it available through the Application and indicate the date of the latest revision.
